TENREHTE warrants performance of its hardware products to the specifications applicable at the time of sale in accordance with TENREHTE's standard warranty. Testing and other quality control techniques are used to the extent TENREHTE deems necessary to support this warranty. Except where mandated by government requirements, testing of all parameters of each product is not necessarily performed.

TENREHTE assumes no liability for applications assistance or customer product design. Customers are responsible for their products and applications using TENREHTE products. To minimize the risks associated with customer products and applications, customers should provide adequate design and operating safeguards.

TENREHTE does not warrant or represent that any license, either express or implied, is granted under any TENREHTE patent right, copyright, mask work right, or other TENREHTE intellectual property right relating to any combination, machine, or process in which TENREHTE products or services are used. Information published by TENREHTE regarding third-party products or services does not constitute a license from TENREHTE to use such products or services or a warranty or endorsement thereof. Use of such information may require a license from a third party under the patents or other intellectual property of the third party, or a license from TENREHTE under the patents or other intellectual property of TENREHTE.

Reproduction of TENREHTE information in TENREHTE product data sheets is permissible only if reproduction is without alteration and is accompanied by all associated warranties, conditions, limitations, and notices. Reproduction of this information with alteration is an unfair and deceptive business practice. TENREHTE is not responsible or liable for such altered documentation. TENREHTE products are not authorized for use in safety-critical applications (such as life support) where a failure of the TENREHTE product would reasonably be expected to cause severe personal injury or death, unless officers of the parties have executed an agreement specifically governing such use. Buyers represent that they have all necessary expertise in the safety and regulatory ramifications of their applications, and acknowledge and agree that they are solely responsible for all legal, regulatory and safety-related requirements concerning their products and any use of TENREHTE products in such safety-critical applications, notwithstanding any applications-related information or support that may be provided by TENREHTE. Further, Buyers must fully indemnify TENREHTE and its representatives against any damages arising out of the use of TENREHTE products in such safety-critical applications.

TENREHTE products are neither designed nor intended for use in military/aerospace applications or environments unless the TENREHTE products are specifically designated by TENREHTE as military-grade or certified for aerospace operation. Only products designated by TENREHTE as military-grade meet military specifications. Buyers acknowledge and agree that any such use of TENREHTE products which TENREHTE has not designated as military-grade is solely at the Buyer's risk, and that they are solely responsible for compliance with all legal and regulatory requirements in connection with such use.

TENREHTE products are neither designed nor intended for use in automotive applications or environments unless the specific TENREHTE products are designated by TENREHTE as compliant with ISO/TS 16949 requirements. Buyers acknowledge and agree that, if they use any non-designated products in automotive applications, TENREHTE will not be responsible for any failure to meet such requirements.

TENREHTE's policy regarding unsolicited idea submissions is as follows: TENREHTE or any of its employees do not accept or consider unsolicited ideas, including ideas for new advertising campaigns, new promotions, new or improved products or technologies, product enhancements, processes, materials, marketing plans or new product names. Please do not submit any unsolicited ideas, original creative artwork, suggestions or other works ("SUBMISSIONS") in any form to TENREHTE or any of its employees. The sole purpose of this policy is to avoid potential misunderstandings or disputes when TENREHTE's products or marketing strategies might seem similar to ideas submitted to TENREHTE.

If, despite our request that you not send us your ideas, you still submit them, then regardless of is documented in your SUBMISSIONS, the following terms shall apply to your SUBMISSIONS. You agree that: (i) your submissions and their contents will automatically become the property of TENREHTE, without any compensation to you; (ii) TENREHTE may use or redistribute the submissions and their contents for any purpose and in any way; (iii) there is no obligation for TENREHTE to review the submission; and (iv) there is no obligation to keep any submissions confidential.

TENREHTE openly welcomes your feedback regarding TENREHTE's existing business. Please provide only specific feedback on TENREHTE's existing products or marketing strategies; do not include any SUBMISSIONS. Any such feedback you provide shall be deemed to be non-confidential, and TENREHTE shall be free to use such information on an unrestricted basis.

Any software which you download is governed in accordance with (i) the license terms accompanying the file or (ii) if no license terms accompany the file, the terms of the license agreement which accompanied the original product licensed by you which you are updating or (iii) the license terms pursuant to TENREHTE's END USER LICENSE AGREEMENT. To the extent a name or logo appears without a visible trademark symbol such as ™, ℠, or ® does not constitute a waiver of any and all intellectual property rights that TENREHTE or its subsidiaries has established in any of its product, feature, or service names or logos.
